A judge has denied a man’s application for resentencing after he was convicted and imprisoned for killing his stepfather during a bizarre fight more than a decade ago.
In December 2013, Brad Lee Davis and 58-year-old Denver St. Clair got into a fight that resulted in St. Clair’s death in Pottawatomie County. Davis told police that he and his stepfather were arguing when he pulled St. Clair’s underwear over his head in an “atomic wedgie,” which left him unconscious and on the ground.
Davis said St. Clair was still alive when he left the room to make a call, but his stepfather wasn’t breathing when he came back.
Police said St. Clair’s death was a result of blunt force trauma and asphyxiation from the underwear being over his head.

Davis pleaded guilty to first-degree murder, and his charge was later amended to manslaughter. In 2015, he was sentenced to 30 years in prison.
Davis recently filed for a modification to his sentence under the Oklahoma Survivors Act, a state law that allows for a reduced sentence and early release if it can be proven that domestic violence or sexual assault was a contributing factor to the crime.
According to court records, Davis’s motion was denied on Wednesday. His lawyer intends to appeal.
