The Delhi High Court on Friday vacated its 2024 interim order restraining the trial court from passing a final order on the framing of charges against the accused persons in the UAPA case alleging a larger conspiracy behind the 2020 North-East Delhi riots.
Justice Neena Bansal Krishna also dismissed a petition filed by riots accused Devangana Kalita, who had sought directions to the police to provide certain videos and WhatsApp chats in two cases linked to the violence.
Counsel for Ms. Kalita urged the court to continue the stay to enable her to approach the Supreme Court. “I won’t be able to do that,” Justice Krishna said.
The court, however, allowed a separate plea by Ms. Kalita, permitting her to inspect “unrelied documents” kept in the police malkhana in connection with the larger conspiracy case.
Ms. Kalita had approached the High Court in 2023, alleging that the Delhi Police had commissioned certain persons to record protests against the Citizenship (Amendment) Act (CAA) and National Register of Citizens (NRC) in February 2020. She sought access to the footage before the trial court proceeded with arguments on the framing of charges, contending that it would show she was protesting peacefully.
In addition to the video footage, she had sought the “entire WhatsApp chat” of a group, alleging that only “selective extracts” were being used against her.
On September 12, 2024, the High Court had directed the trial court not to pass a final order on the framing of charges in the case under the Unlawful Activities (Prevention) Act (UAPA).
Ms. Kalita, along with student activists Natasha Narwal, Jamia Coordination Committee member Safoora Zargar, former AAP councillor Tahir Hussain and others, has been booked under various FIRs in connection with the riots, which left 53 people dead and over 700 injured in February 2020.
