The Union Government has advanced eviction proceedings against the Delhi Gymkhana Club, with the Estate Officer issuing a statutory show cause notice under the Public Premises (Eviction of Unauthorized Occupants) Act, 1971. The Club has been asked to explain why an eviction order should not be passed against it.
The notice, issued under Section 4(1) read with Section 4(2)(b)(ii) of the Act, follows a government plaint alleging the Club has become an unauthorized occupant of a 27.3-acre property located at 2 Safdarjung Road, New Delhi. According to the Land & Development Office (L&DO), the Club’s continued occupation after lawful termination of its perpetual lease and resumption of the land by the government for public purposes constitutes “unauthorized occupation” under Section 2(g) of the Act.
The government stated the lease was terminated after the President of India exercised powers under Clause 4 of the perpetual lease deed, which allows resumption of land required for public use. It asserted that following lease termination, the Club ceased to have any legal right to remain and its continued occupation is unauthorised.
The Estate Officer has directed the Delhi Gymkhana Club to show cause by July 7, 2026, why an eviction order should not be made. The Club must appear before the Officer on July 7 at 2:30 PM, either through office-bearers or an authorised representative prepared to answer questions and submit evidence.
The notice warns that failure to appear or file a response may result in ex parte decision, permitting eviction orders without the Club’s input.
The show cause notice follows the government’s plaint seeking a declaration that the Club is an unauthorized occupant and requesting its eviction under the Public Premises Act. The government described the property as valuable public land in a strategically sensitive area needed for defence, public security, governance infrastructure, and other public-interest projects.
After terminating the lease by notice dated May 22, 2026, the government directed the Club to hand over peaceful possession by June 5, 2026. The Club’s failure to vacate has led to the present proceedings. The government seeks eviction of the Club and restoration of possession to the Union of India.
